Terms of Service

1. Acceptance of Terms

By accessing or using LeanPathMD ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use the Platform.

2. Not an Emergency Service

LeanPathMD is not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Platform for urgent or emergency medical needs.

3. Telehealth Services

LeanPathMD connects patients with independently contracted, licensed healthcare providers ("Providers") for telehealth consultations. Providers are not employees of LeanPathMD. The Platform facilitates communication between you and Providers but does not itself practice medicine or provide medical advice.

Telehealth services have limitations compared to in-person care. Providers may determine that telehealth is not appropriate for your condition and may recommend in-person care.

4. Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you represent that you are 18 or older. Services are available only to residents of states where our Provider network is licensed to practice.

5. Accurate Information

You agree to provide accurate, complete, and current information in your intake form and all communications with Providers. Providing false or misleading medical information may result in harm to your health and termination of your account.

6. Prescriptions and Medications

Prescriptions are issued solely at the discretion of the treating Provider. LeanPathMD does not guarantee that any prescription will be issued. GLP-1 medications and other prescription drugs carry risks and side effects. You are responsible for reading all medication guides provided by your pharmacy and following your Provider's instructions.

7. Fees and Payments

Consultation fees and subscription fees are charged as described at the time of purchase. All fees are in U.S. dollars. Fees are non-refundable except where required by law or at our sole discretion. We use Stripe for payment processing. By submitting payment, you agree to Stripe's terms of service.

8. No Insurance

LeanPathMD does not bill insurance. Services are paid out-of-pocket. We do not submit claims to Medicare, Medicaid, or any other government health program.

9. Limitation of Liability

To the maximum extent permitted by law, LeanPathMD and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or telehealth services. Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LeanPathMD, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may cancel your account at any time by contacting us at support@leanpathmd.com.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Travis County, Texas.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify registered users of material changes via email.
